Black & Decker to pay $960,000 in Civil Penalties for Failure to Report Defective Product - Grasshog XP Weed Trimmer/Edgers

The U.S. Consumer Product Safety Commission (CPSC) recently announced that Black & Decker (U.S.) has stipulated to pay a monetary settlement amounting to of $960,000 to resolve CPSC allegations that the company knowingly failed to report defects and safety hazards associated with its Grasshog XP, as required by the Consumer Product Safety Act. The CPSC staff further alleged that the firm withheld certain information specifically requested by CPSC staff members during the pendency of CPSC's investigation.

The Consumer Product Safety Act, codified at 15 U.S.C. §§ 2051−2089, requires distributors, retailers and manufacturers to report within 24 hours to CPSC after obtaining information which would tend to support a conclusion that an item contains a product defect which could create a substantial product hazard, creates an unreasonable risk of serious personal injury or death, or fails to comply with any consumer product safety rule, regulation, standard or ban enforced by the Act.

CPSC staff members had alleged that "Black & Decker had knowledge, on or before May of '06, that its Grasshog XP GH1000 was a defective product and could cause harm, but failed to report this to CPSC."
CPSC further alleged that Black & Decker did not furnish complete information with regard to product defects associated with the Grasshog XP as requested in May of 2006. Allegedly, Black & Decker did not provide to CPSC staff the full, requested information with regard to the extent of Grasshog XP product defects or the mounting number of incidents and personal injury until October of 2006. Upon agreeing to enter into settlement with CPSC, Black & Decker (U.S.) Inc., maintained its denial regarding the above-referenced allegations of product defect and violation of law.
