Defective Product Attorney Advice Column Part 3

After a week away, we return to the SHOOP | A PROFESSIONAL LAW CORPORATION Defective Product Attorney Advice Column with big news regarding a very largeproduct recall involving nine (count 'em 9) manufacturers and distributors announcing a Consumer Recall of Pourable Gel Fuel Due to Burn and Flash Fire Hazards.

As you may remember, we blogged back in July with regard to the Napa Home & Garden Recall of its NAPAfire and FIREGEL Pourable Gel Fuel Due to associated fire and burn hazards.

Now very recently, the United States Consumer Product Safety Commission (CPSC), in cooperation with the nine manufacturers and distributors listed below, is announcing a voluntary recall of all pourable gel fuels manufactured or distributed by these various companies. As we noted in July, and as these various companies made clear to CPSC, serious risks of flash fire and burns exist when consumers add this pourable gel to a previously burning pot. CPSC advises that consumers should immediately stop using the pourable gel fuel.

This broad-sweeping recall will involve an estimated two million units of these various pourable gel fuels which are generally packaged in 1 quart plastic bottles and/or 1 gallon plastic jugs. These pourable gels hit the market in 2008 from the companies listed here:

  • Bird Brain Inc.
  • Bond Manufacturing
  • Sunjel Company (2 Burn Inc.)
  • Fuel Barons Inc.
  • Lamplight Farms Inc.
  • Luminosities Inc.
  • Pacific Décor Ltd.
  • Real Flame
  • Smart Solar Inc.

As we discussed previously, this pourable gel fuel can ignite without warning and splash on people and objects nearby. CPSC has already been made aware of sixty-five incidents resulting in two deaths and dozens of victims who were hospitalized with second and third degree burns of the face, chest, hands, arms or legs.

CPSC has also noted that of these scores of incidents, 28 of them, which unfortunately include 2 fatalities, occurred with fuel gel products made by Napa Home & Garden. CPSC in June released a press statement warning consumers of the hazards and product defects associated with these pourable gel fuels.

To address the issues with defective design, some firms are working on a new design for caps or tops that seek to prevent these flash fire hazards.
