The product liability lawyers at Shoop | A Professional Law Corporation remind the public of the Summer Infant "Baby Bather" recall. This product recall was prompted by an unacceptable risk of fall injuries and head injuries. This recall was voluntarily initiated in conjunction with the United States Consumer Product Safety Commission ("CPSC") and Health Canada.
The actual name of these products are "Mother's Touch Deluxe Baby Bathers," of which approximately two million are in distribution throughout the U.S. and an additional 65,000 such units in Canada.
The baby bathers are manufactured by Summer Infant, Inc., of Rhode Island.
The product defect associated with these infant bathers involves incidents wherein the child is lifted or carried and the units' folding wire frame suddenly disengaging from its hinge which, in turn, causes the baby to be dropped from the bather, posing a risk of falling and head trauma to infants.
Summer Infant and the U.S. Consumer Product Safety Association are in receipt of seven (7) incident reports from the field which include five (5) such reports of children experiencing head trauma from falls from these bathers. Several children between two received fractures of the skull, including one case where the child was admitted to the intensive care unit for a brain bleed.
