THE HI-RES 90K DEVICE
On November 23, 2010, Advanced Bionics (AB) announced, in conjunction with United States Food & Drug Administration (FDA) that it would be recalling the entirety of its HiRes 90K cochlear implant devices and begin the process of retrieving all such, yet-to-be implanted cochlear devices currently in distribution. This action is being taken in response to multiple instances of product failure wherein device recipients experienced a malfunction requiring device explantation. These recipients experienced severe pain, very loud sounds and additionally experienced shocking sensations roughly a week to ten (10) days subsequent to the initial activation of their HiRes90k implant.
WHAT YOU SHOULD DO
In the event of a failure of a cochlear implant, it is important to contact us immediately. Often times the manufacturer will attempt to negotiate a minimal settlement with you if you do not have legal counsel. They will then have you sign a release which could affect your rights to pursue a claim further.
Often times these claims involve children with defective implants. Typically, a manufacturer must get court approval to compromise a claim involving a minor before it affects a child's rights to recover for damages in future proceedings. If you or a loved one have experienced a failure of the HiRes90k - or a failure of any cochlear implant - contact our team immediately so that we may provide a free of cost evaluation and initial discussion of your potential claim.
