The Device

Advanced Bionics has admitted that certain of its HiRes 90K cochlear implants can potentially fail as a result of high moisture levels. The devices are required to achieve a hermetic seal. The HiRes 90K implants which were not implanted in patients were removed from the market. FDA further stated that implant recipients were to be monitored carefully for signs of device failure, including but not limited to:

  • Intermittent functionality;
  • A complete loss of sound from the device;
  • Sudden onset of pain, popping, shocking, discomfort, noise, and/or popping sounds.

The HiRes90k implant recall was initiated originally on March 8, 2006. In the United States and Canada, the clinician notice letters were sent out via facsimile and, for various other localities, an Advanced Bionics distributor or representative were supposed to provide such notice to affected clinicians. As part of this notification process, customers were allegedly given a list of HiRes 90K implants with feedthrus from Supplier B that were shipped and were not yet registered with Advanced Bionics. Customers were asked to return the implants listed in the attachment to Advanced Bionics according to the instructions. Customers were told not to implant any of the devices on the list. Customers were told that implants manufactured with feedthrus from Supplier A will be delivered in an attempt to “minimize disruptions to their schedule”.
