Advanced Bionics Hires90k Lawsuits

The product liability lawyers at SHOOP | A PROFESSIONAL LAW CORPORATION continue to investigate and take on additional matters relating to the recall of the Advanced Bionics HiRes90k cochlear implant. No other law firm in the nation handles more cochlear implant claims and lawsuits than we do. Let us put our product knowledge and experience with this device to work for you.

The Device

Advanced Bionics has admitted that certain of its HiRes 90K cochlear implants can potentially fail as a result of high moisture levels. The devices are required to achieve a hermetic seal. The HiRes 90K implants which were not implanted in patients were removed from the market. FDA further stated that implant recipients were to be monitored carefully for signs of device failure, including but not limited to:

  • Intermittent functionality;
  • A complete loss of sound from the device;
  • Sudden onset of pain, popping, shocking, discomfort, noise, and/or popping sounds.

The HiRes90k implant recall was initiated originally on March 8, 2006. In the United States and Canada, the clinician notice letters were sent out via facsimile and, for various other localities, an Advanced Bionics distributor or representative were supposed to provide such notice to affected clinicians. As part of this notification process, customers were allegedly given a list of HiRes 90K implants with feedthrus from Supplier B that were shipped and were not yet registered with Advanced Bionics. Customers were asked to return the implants listed in the attachment to Advanced Bionics according to the instructions. Customers were told not to implant any of the devices on the list. Customers were told that implants manufactured with feedthrus from Supplier A will be delivered in an attempt to “minimize disruptions to their schedule”.

WHAT SHOULD I DO IF MY HIRES90K DEVICE FAILS?

You may have received a letter from Advanced Bionics notifying you that the implant you or a loved one received contains a component called a feed-thru device which was manufactured by a "Vendor B" (an unapproved, device-component supplier). The components manufactured by this supplier have failed at an alarming rate due to excess moisture, amongst other issues in our experience with this component, some feed-thrus have separated entirely from the unit, causing catastrophic failure. It is very important if you are a Vendor B recipient NOT to sign a release with Advanced Bionics in exchange for nominal reimbursement. This could potentially affect your legal rights to recover additional sums in a lawsuit or settlement with the company.

If you or a loved one suffered a failure of a HiRes90k implant, it is very important to contact our legal team immediately so that we may provide a FREE of cost case evaluation and initial discussion of your potential case.
