Defective Conveyor Belt and Punching Machine accidents

Defective Machinery Lawyer in Los Angeles

At Shoop | A Professional Law Corporation we provide representation to clients in the Los Angeles area injured by defective conveyor belts and defective punching machines. Machines such as these with moving parts can cause bone crushing injuries and amputations. Our firm seeks to help you gain the compensation you need for your medical care and family expenses so you can get back on your feet again.

Safety Requirements for Equipment with Moving Parts

It has long been established that equipment with moving parts such as conveyer belts should not have missing safety guards. In 2000 The American National Standard Safety Standard for Conveyors and Related Equipment (AWSME B20.1-2000) stated:

"Where necessary for the protection of personnel from hazards, all exposed moving machinery parts that present a hazard to personnel at work stations … shall be mechanically or electrically guarded, or guarded by location or position…. In general, nip and shear points shall be guarded unless other means to assure safety are provided."

Insofar as punching machines also have a nip point, the same safety guard requirement arguably applies. Where conveyer belts or punching machines have no guards and injuries occur, a claim for design flaw is in order.

Should there be not be a plainly displayed warning of dangers, that too would be grounds for suit. If the equipment simply malfunctions, causing injury, the manufacturer would be strictly liable for a manufacturing defect.

What We Do

When a client comes to the firm, we fully investigate the incident and examines the equipment for grounds for claim. Once liability is established, we bring suit for medical expenses, hospitalization costs, loss of income, and pain and suffering. Where there has been permanent injury, we seek compensation for lost earning capacity, rehabilitation, and retraining expenses.

Don't let your life fall apart after an accident with defective equipment. We are here to hold the negligent parties responsible and secure compensation. Contact Shoop | A Professional Law Corporation for tenacious representation.
